I was in a car accident yesterday. I live in California. I had no insurance at the time, although I was unaware that my girlfriend had not sent in my quarterly paryment and was actually driving without insurance for almost 3 months. The day after the accident I went in to the Highway Patrol's office and spoke to the officer who took the report and informed him I discovered I had no insurance. He didnt seem all that concerned and thanked me for going in. As for the accidnet itself, I belief I will be found at fault as I did not brake in time and rear end a small car who in turn hit the car infront of her. I was traveling at about 30 mph when I started to brake and I heard the firefighter at the seen tell the chp he thought it was 25-30 mph. If anyone could tell me what I am facing legally and finacially. I read online I will automatically have a one year driver's license suspension. Is this accurate and is this all? WIll I ge a ticked or fine? I would also like for someone to rule out jail time. The driver immediately infront of me had good damage to the back of her car and was taken to the hospital with minor injuries. Her daughter called me the day after the accident and told me she was at her house but wanted her car fixed soon because she wanted to return home in another state. I suggested she call her own insurance and let them know I was inot insured. THe other driver in front and her passenger were also taken to the hospital with minor injuries and their car had minor damage when I looked at it at the time of the accident. I have not heard from them. Financially can anyone tell me what I am facing? I understand I will be responsible, but I also understand that the other parties' insurances will have to cover their own drivers. If so will I simply be responsible for their deductable. My 17 year old son was driving his 2003 Ford Explorer, when he was hit by another vehicle. My son was approaching a stop light and traveling between 3-5 mph....The vehicle that struck him was a company work vehicle. The work truck was pulling out of a parking lot when he hit my son. His estimated speed was also 3-5 mph. There were no injuries at all, and there was no medical treatment sought. This all happened on April 10th 2011. It was found that driver of the work truck was at fault for inattention. Honestly, this guy was super nice and walked my son through the process of calling police etc til I could get there....Now dealing with the Companies insurance carrier has been a headache!!!! here is the basic timeline....Explorer still drivable....Had to wait 10 days for police report....contacted Company that owned work truck, and they forwarded me to their insurance co....Was advised to seek several estimates, and fax them over....Faxed over estimates to adjuster. All estimates exceeded 5k....Stated she would have to contact an adjuster from local area to work this. Local adjuster came out. Estimated damages to be 3300.00. Insurance Company sent me check for 3300.00 and advised me when vehicle repaired, auto shop would need to work with adjuster on any additional repairs and costs. Explorer was in shop 30 days before finally being totaled. Local adjuster was horrible to work with, did not communicate with body shop, etc. I finally contacted the insurance company, and told them I refused to deal wither contracted adjuster etc. Now that the vehicle has been totaled, they don't want to pay what I think is fair. The insurance company wants to settle for $6928 plus $367 for taxes. Clean retail for the Explorer is $8100. This is for my area. I have been car shopping for 2 days straight. can't find anything comparable with the money they gave me etc. I have taken off work to deal with this etc, been going on for 2 months plus, and Iam worn out with it all...All I want is for my kid to be back in a safe reliable vehicle. The insurance company did provide a rental car. I had to drive it, my son had to take my car, my other son had bought our car from us, but can't get it yet, because the other needs it for work school etc....I am so frustrated with the ins ompany

Hi, Recently I bought myself a Vauxhall Corsa SXI 2003, and have been looking around for car insurance. PPAC seems very similar in nature to the Community Reinvestment Act that played a role in the 2008 financial crisis. The PPAC requires insurers to offer the same premium (price fixing) to all applicants of the same age and geographical location without regard to most pre-existing conditions (excluding tobacco use). It also states that minimum standards for health insurance policies are to be established and annual and lifetime coverage caps will be banned. As a business owner, I don't see where the government comes to the conclusion that insurance companies could survive the price fixing and taking on such high risk liabilities. It seems like 2008 all over again, does it not? Wouldn't they get involved in something similar to what the banks did with derivatives since they were forced to take on high risk loans? It seems like the big focus on Obamacare is the part where people are forced to buy insurance. I don't think that is a big issue, the big issue is how can the insurance companies handle this? Am I wrong? I am going to do more research tonight.

Hi: My 1996 toyota corolla was hit by another car in the rear on the passenger side. My car was in excellent condition, everything worked, nothing broken, no rust (paint in excellent condition as it is always in my garage at home or in a covered parking lot at my workplace), low mileage (130K), never had a problem and I am the original, sole owner and driver of the car. I was planning to keep driving it for years to come. Now the insurance company wants to total my car and what they are offering for my car /their initial proposed settlement of $3500is not nearly enough to buy another car in the same excellent, safe and reliable condition, that is not riddled with hidden problems. This presents a big problem for me as, if I cannot have my car fixed and restored to the same condition as before the crash, I would have to come up with at least $12K to $15K to buy another new safe, reliable economy car. This is an expense that was not in my plans. Also, the insurance company is pushing me to make a hasty decision and is threatening me with not paying for the car rental I needed to get (since my car cannot be driven as the tail light is broken and and rain would get in the car). Is there any way that the insurance company can be prevented from totaling my car and instead pay for properly fixing the car with good OEM parts instead of used (LKQ) parts. I got several estimates, two for around $5K and one for around $7K (this one is from an excellent body shop that has done excellent work on my other previous cars before). The insurance company provided and estimate for $4k using used/LKQ parts. I would appreciate any advice on how to get the best settlement from the insurance company.

I think their ads on TV are so right - they have not only the lowest rates (at least for me), but the best customer service too. I have never filed a claim, but recently requested some insurance record from them. Even though I am not their customer anymore (currently do not own a car), they still were very helpful on the phone, sent me the requested letter immediately and even did a follow up on it. Some background first, i was hit from behind whilst stationary in traffic the other week by a works van. the damage was not too sever that i couldn't limp back home (sore and car bashed but still alive) got the other drivers details at the scene and reported the incident to my insurance company. As the accident was not my fault my insurer passed this to their dedicated Non-Fault (NF) accident claim company (i'll not name them at the moment) who in turn provided me with a hire car and collected my car to have it assessed for REPAIR. At no point was writing off the car mentioned. Then i got a call from the garage dealing with my car (NF appointed) a week later telling me of the damage and repair value and that the engineers working for the NF, different company again, were going to deem the car a write off, CAT D as i later found out. Now the fun part - the engineers have made an offer for settlement and to write off of my car, which is a good 500 below what is would cost to replace it with a like-for-like car in my local area (replace cost circa 2.8k-3k) they are adamant they will not repair my car even though the repairs would cost LESS than the write off - because the repair is too close to the market value and they can make a killing on salvage apparently. so fighting this out at the moment. NOW FOR THE QUESTION: They have advised me that should i wish to keep the car after they write it off (which i want to avoid if at all possible) i can accept the settlement and pay them a salvage fee to retain my car. This i understand as technically they buy my car when they write it off and then i have to buy it back. The problem is that they have a flat 30% !!! salvage fee which on their offer would almost negate me being able to get the repairs covered. What i really need to know is if anyone else has been in this position and if there is a maximum salvage fee they can charge - bearing in mind that this is my car to start with - and if there is any way i can make them drop this percentage. Forcing them to drop the percentage might not only let me repair the car after retaining but might also swing in favour of repair instead of write off if they cannot justify such a big payout for themselves. Any help here would be appreciated fast as i'm still bouncing between the parties here to get this resolved. In case your wondering the damage constitutes a bumper rear panel and a kink in the boot floor - VERY repairable.

Alright, I turned 16 a few months ago and got my license the day after my birthday. The majority of cars that we have looked at are around $1500 a year for just liability. Auto Insurance - what went wrong here?

Where did I go wrong? A few months back, I backed out of a parking place and stopped, waiting for traffic behind me to resolve itself. While stopped, a large vehicle backed into my driver side door. We both re-parked. The other driver first tried to convince me there was no damage and we should both forget it but after I showed him the damage to my door (his car had almost no damage), we exchanged insurance and personal contact information in a friendly conversation. I reported the damage to my insurance carrier, a large national firm, obtained the required 2 estimates for repair and submitted it, as directed by my carrier and his, to his carrier, a large regional carrier. They informed me he had decided my car was not stopped and so I bore responsibility for his backing his car into me (!), and they therefore were refusing to pay me. My insurance carrier said it was up to me to provide proof my car wasn't moving, regardless of the fact his car backed into mine! I approached the repair firm, and they provided me with photos and offered testimony to state that my car was obviously stopped, based on the damage to the door. I called the individual and said with this information unless he paid the bill in full, I would take him to small claims court. He argued but produced a check for the full amount. A month later, my insurance carrier raised my rate based on this incident and a highway speeding ticket over a year ago. I ended up paying more for my insurance and lost a great deal of time despite both of us being insured. Where did I go wrong?

Sued for Auto Accident Above Insurance Limit in NJ?

One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

Okay, I can see having a mandatory policy, or coverage plan in the event there is an accident, and someone gets hurt. That, I understand. But here is my real question: Every month, every year, we all pay into somthing called (car insurance), we pay, we pay, then we pay some more. So when its all said and done, and after a month, a year, whatever, why dont we get ANY of the money back that we paid, seeing as how (WE NEVER HAD AN ACCIDENT)...... I know that there will be a slew of morons who say its the law , or its to cover your butt if you get hit , and so on, and so on. Duh.... But no matter how you swing it, I've paid into it for the last 7 years, never had an accident, and I've paid thousands, so why dont I get any of that money back, what did I pay for? I can even understand a situation where we all paid for auto insurance but get a certain percentage back, but to mindlessly pay money into a machine and get nothing in return, how is this not giving money away.. Oh, and when its all said and done, imagine you pay for coverage every month, 200+, then some (fill in the blank) who dose not have insurance smashes into your car at night because he or she was drunk, you wake up in the morning, report it, your rates go up. Get hit by someone who dose'nt have insurance, your screwed, so in all honesty, whats the point. Have you every been in an accident, then tried to file a claim, its like pulling teeth. Investigators and claims agents come out of the woodwork, and did you know thier job is to find a reason to deny your cliam?

The guy who hit me does not have an ample amount of insurance to cover my injuries. They are offering me the policy limits to settle. My own uninsured or uninsured motorist has been given enough documentation to know that my additional insurance will come into play. I have filed suit against the guy and his insurance company, but do I need a letter of consent to settle with them from my own insurance company to make sure that my uninsured motorist coverage will still be available to me. I really think it is criminal for any insurance company or state to make the limits on auto insurance so low, when the average cost of an auto accident is higher than the minimum coverages that they allow drivers to driver under. Also, there are many attorneys that wont even look at taking a case unless the limits are much higher than state minimum, because they can make considerably more on those who are very well insured. My own insurance company is treating my like I am retarded, and I was until I started reading all the insurance laws and bought a very fine civil litigation book for 4 dollars, best investment I ever made. But I am no Pro Se expert, my hat is tipped to you attorneys and insurance adjusters. What a stressful job you have and so many laws to abide by and to follow. I drive a 98 Chevy Suburban, because it has a lien holder (bank) it has had full coverage insurance the life of the loan. I am a first year student a University, in full time education and I am planning to drop out of University within a month or so. My car insurance does say I am in full time education but when I leave; I will be classed as unemployed. If I leave in January, I am technically unemployed, can I still leave my occupation as full time University student? And how would the insurance company find out? Because to change my occupation title; the insurance company is charging 400. I have 8 months left till my renewal and by then I'll have a job and keep my insurance company updated about the changes in my occupation. What are the consequences that can happen?

Insurance totalling my car looks suspicious?

At this point I regret making a claim and wish i could turn back the clock. I am being forced into a box and it looks shady. Three weeks ago my 2005 Cadillac STS was involved in a parking lot flood where the water rose and filled the floors of my car by about 4 inches. All us neighbors had cleaning parties using a wet vac and baking and toweling are cars in the sun over the next few days letting our vehicles dry out. On my car everything works like a dream as it did before with the exception of a 'check stability control' notice that comes on when I start the car. I have been driving the car fine since the flood and decided maybe I should make a claim to fix this error that pops up on the dash when i start the car. From the time I dropped it off at the dealer it has been all negative. Right away the dealer was negative and telling me it's the end of the world with my car, everything is ruined and it will probably be a total loss. He got the adjuster for my insurance company out there and it looks like it will be put in to the total loss category. No i am just asking the insurance company to forget everything and drop the claim because the damage is not that extreme and i dont want to lose my car. I am told at this point it is too late. Is that true? My neighbors are floored by this, i have been driving it around for a few weeks just fine and the car still looks new With only 62000 miles on it. I can't help from thinking that something suspicious is going on here. Do they stand to make a nice profit by totalling my vehicle and then replacing one module for a 1000 or so and having a perfect car with all systems working? Also the lady from the claims office said the car had to be 80% damaged for it to be a total loss. I asked her if this was based on speculative problems that they think may occur in the future because of the water, or based on actual damage now? She said it had to be actual damage now but couldn't give me any details from the adjuster yet. Can I demand that the adjuster list everything that he thinks has been damaged to my car (which I am convinced he will have to be creative to do so)? The car as i said drives wonderful, I checked the fluids on my own (fine), and the car looks new. Do I have any recourse here? I just want the car fixed for the one problem, i dont want to lose the car, and at this point I don't even care about having insurance fix the one problem, but again I am told it is too late to go backwards and drop this entire issue. I almost have an inclination to report this because it looks so shady. No reasonable person would look at, and drive this car and consider it a total loss. What is the agenda of the insurance company and cadillac dealer here? Something smells foul with this situation.

I have a car that is worth no more than $1500. I bought it off someone in my family and I should transfer ownership (as it is from a different state). I was hit by other guy ,he was at fault so their insurance ( B) absolutely must pay to fix my car .Nothing relate to my insurance ( farmer ). they estimate the cost to fix at their shop is 7k while BMW estimate for me is 13k (if there is hidden cost to fix the car, B will have to pay it too,thats the law). Hey, three weeks ago, I got into a car accident and rear ended someone in the front with suv. I had a honda, and the insurance company declared it totaled and they are going to pay around 9k for the car. Since it was rear-end accident, insurance company held me for 100% at fault. The suv had broken/dented bumper and lower part of trunk lid dented (No broken lights or anything). I would say around few thousand dollars worth of damage. When I called at night to get one of the guy's birthday, he said all three went to emergency, and had whiplash pain in neck area (which is understandable from rear-end accident). Bad title for this question I know. I have never really had to go to the doctor for anything, ANYTHING. But still, I'm okay with that, if its like one visit every six months or so, so what. Anyways, they found my Testosterone levels to be really really low. So they put me on a medication called androgel. Let me tell you, I can only get 15 days worth of this medication at a time, but every time I go to Walgreens to get a refill, I spend hundreds. Tonight when I picked it up it cost me $268.41. I called everywhere to see about health insurance, even though I only need help with prescriptions. I dont know what to do. I dont need all out full fledge health insurance. But apparently if I tried to get it anyway, I would be denied due to a pre-existing condition *1!! Apparently the only people who can qualify for health insurance are those who dont need it to begin with. And those who need it are denied because of a pre-existing condition. They are no programs that help with prescriptions that I know of, that dont require tons and tons of paperwork, audits, background investigations, and appointment after appointment. I am really upset and am lost with regard to getting the medication my doctor says I need, reduced in price. I cant afford almost $600 a month. They now show on our credit report. I live in Colorado and I got a letter from my doctor today telling me I have to pay $90 a year to use insurance with him. He also said that every time they have to send a request for authorization for something and they get it back and have to ask again they will charge you $75. This is kind of bothering me because I am waiting to have surgery and am not working and can't afford much more than just a co-pay. Does this sound normal for a doctor to ask for this?
